UPI Fraud Complaint in India: What Evidence Is Needed for Legal Action?
A random UPI payment can spoil anyone’s day and escalate it to a financial crisis. You’re looking at your phone, reading a payment notification. Within minutes, your account is short by some money, and you have no clue who got it.
For some victims, it could mean thousands of rupees gone in a snap. For some others, this might be money they saved for working capital for their business or medical emergencies or children’s education or money kept aside for household expenses.
The financial loss is one problem. The second question that troubles them is: Will my bank return the money? Can the police catch the culprit?
A UPI fraud complaint is an official statement of dissatisfaction regarding suspicious activity related to the Unified Payments Interface. The victim can file a complaint with the bank, the application they used to transact, cyber cell or police station. Each of these complaints are for distinct purposes- be it stopping additional loss, probing into criminal activity or deciding who is financially at fault.
UPI frauds can happen due to duped customer-care numbers, tampered QR codes, illegitimate payment requests, identity theft, pseudo investment offers or by hacking into one’s bank account. While some conning tactics are based on fooling the user into accepting the transaction, few indulge in stealing your bank credentials as well.
We take a look at everything about UPI fraud complaint in India in 20-26. Learn about why you should file a complaint, proofs to document the transaction, what the bank owes you, how criminal law can be applied and when to escalate a complaint and when to hire a lawyer.
Why UPI Fraud Complaints Matter in India in 2026
UPI has become an every day part of our lives. We pay our kids’ school fee via UPI, merchants show QR codes to collect payments from customers and companies pay vendors — all cashless.
But there’ also a downside to the instant digital transaction system.
Imagine a guy from Noida gets a call from someone claiming to represent the fraud-control department of a bank. He’s told his account is about to be suspended unless he confirms his identity. When a payment request shows up on his phone, he quickly keys in his UPI PIN to “protect” his account.
But he’ actually just giving away his money.
What about a retailer in Gurugram who receives a counterfeit payment screenshot from an online buyer? Or how about a Delhi resident who wires money to someone else claiming to rent out a property that doesn’ exist?
Each scenario presents its own set of facts and legal considerations. But there is one element that links them all..
To share frustration does not solve problem.

What Is UPI Fraud and How Is It Different From a Failed Payment?
UPI fraud typically refers to intentional misconduct relating to a UPI transaction, like impersonation, deception, unauthorised access or stealing of funds.
A failed payment isn't that. Your money can get debited due to a plain old technical glitch without reaching the recipient. These cases normally get resolved by the payment- system dispute/reversal process, instead of being treated as fraud automatically.
Unauthorised UPI transactions
An unauthorised payment is when funds are paid out of an account without valid authorisation from the account holder.
This may include stolen account access details, stolen payment details or otherwise fraudulently.
Questions about whether the payment was verified, if the customer approved it, and the bank's proof of the transaction are central.
UPI payments obtained through deception
Other victims authenticate by voluntarily entering their PIN, but only because they have been misled by the recipient as to the purpose of the payment. So you might have a fake trader receive money for goods which don't exist, or someone pretending to be from your bank tricking you into authorising a payment. Clearly cases like this can involve criminal deception even where the payment system cannot find evidence of unauthorized activity. Knowing the difference between unauthorised banking transactions and authorising a payment due to fraud BK Singh Advocate notes is crucial when determining liability and relief for consumers.
Payment errors and commercial disputes
Transferring money to an incorrect UPI ID is not in itself proof of fraud. Merely because a merchant has failed to supply goods does not mean he has committed criminal cheating in every circumstance.
The sender's original intent, follow-up conversations, transaction details & circumstances can indicate if the dispute is civil/commercial or criminal.
Which UPI Fraud Methods Create the Greatest Legal Risk?
Different scams leave different forms of evidence. Understanding the alleged deception helps identify what actually happened.
Fake customer-care and bank verification calls
Fraudster can pose as bank employee, payment app executive or support service provider. Victim could be influenced to divulge confidential information or confirm a transaction. Caller ID, recorded calls (where legally permissible), messages and transaction alerts can all become critical pieces of evidence.
QR code and payment request scams
Someone might instruct you to scan a QR code or confirm a collect request to claim a refund/prize.
Legitimate incoming transactions will typically not ask you to enter your UPI PIN just to receive funds. The appearance of a PIN authorisation screen usually means you are making an outgoing payment or performing another secured banking operation.
Victims ought to pay attention to what was shown on the screen, not just what the criminal told them.
Investment, employment and rental scams
Ponzi schemes may show fake profits initially to persuade you to send more money.
Fake job recruiters may ask you to pay a registration fee. Bogus rental listings may request money upfront as rent or a security deposit.
Although one payment may not seem like a lot of money, continually wiring money can leave you financially drained.
Remote-access and malicious application fraud
Fraudsters may trick victims into downloading unknown applications, allowing screen sharing or giving permissions to access personal information.
In cases of taken over accounts, the account safety window and proof of device usage can become very important.
Merchant and business payment fraud
Customers fake payment acknowledgements/receipts, replace QR codes with dummy ones and assert payments were successful when there was no money received by businesses.
A screenshot does not guarantee that funds were deposited. Ensure Businesses Merchants know the difference between standard reconciliation issues and intentional financial fraud, says BK Singh Advocate.
What Indian Laws Apply to UPI Fraud Complaints?
UPI fraud can fall under several areas of Indian law that may overlap. Banking regulation, criminal statutes and payment-system rules each deal with different aspects of the same incident.
Cy Criminal Laws
Bharatiya Nyaya Sanhita, 2023
The Bharatiya Nyaya Sanhita, 2023 (replaced the Indian Penal Code in respect of offences covered by the Act) has several sections that may relate to dishonest inducement and false identity.
Section 318 - cheating
Section 318 would cover cheating. If deception is used to dishonestly induce delivery of property, the facts may fall under cheating and dishonest delivery.
Section 319 - cheating by personation
Section 319 specifically covers cheating by personation. This section could apply if an offender falsely claims to be a bank officer, another individual, or even an authorised representative.
The exact offence would depend on what is proven about deception, intention and actual conduct. Not every failed online transaction attempt is cheating.
Information Technology Act, 2000
Section 66C deals with identity theft and fraudulent or dishonest use of another's electronic signature, password or any other unique identification feature.
Section 66D pertains to cheating by personation using computer resource or communication device.
Provisions under other sections would become applicable if the complaint alleges hacking/unauthorised access to a system or other computer related misconduct.
These provisions would not apply to every UPI related dispute. Facts and statutory criteria would be relevant.
Bharatiya Nagarik Suraksha Sanhita, 2023
Criminal Procedure will be governed by Bharatiya Nagarik Suraksha Sanhita, 20 23 in respect of any offences which fall under its purview.
The Bharatiya Nagarik Suraksha Sanhita, 20 23 deals with procedure in respect of criminal information and investigation as well as subsequent proceedings.
If the complaint to police is regarding a cognisable offence, then corresponding registration and investigation requirements would apply.
Filing a complaint to the national cybercrime portal is lodging a complaint; it should not be construed as conclusive evidence that an FIR is already registered.
RBI banking protections
The RBI guidelines on customer education on unauthorised electronic banking transactions lays down norms on timelines of reporting, customer carelessness, liability and obligations of the regulated bank.
Nil liability is provided under certain conditions where blame lies with the bank or a third party breach which was reported within 3 working days of receipt of the notice from the bank. Please see directions dated 2017.
Negligence on part of customers and fraud induced authorized payments are different issues.
This clarification usually comes into play where a bank has denied refund on the grounds that the said payment was authorized over customer credentials.
You can consult BK Singh Advocate to see if the RBI Norms and the reasons stated by the bank for refusal to refund covers the facts of the erroneous transaction as claimed.
How Does the UPI Fraud Complaint Process Work in India?
Submitting a UPI fraud complaint can involve dual reporting to your bank & law-enforcement. One doesn't necessarily substitute for the other.
Reporting through the bank
Your bank should be the first place you report suspicious unauthorised debits. Use official channels and keep your complaint reference number. Your bank can review authentication of the payment, history of transactions, customer alerts and if there should be additional controls in place. Filing a bank complaint also provides you with a date of when they were notified.
National cybercrime reporting
1930 is a national helpline number to instantly report cyber financial fraud. The National Cyber Crime Reporting Portal is an online platform to report cybercrimes. Early reporting can help with coordination of suspected beneficiary accounts. However, an attempted freeze, a pending freeze or an acknowledgement of your complaint does not guarantee that the funds have been recovered. The funds could have been withdrawn from that account.
UPI application complaints
Most payment apps come with a support or grievance system for transaction based complaints. Payment related issues like pending payments, failed transactions and disputed transactions can be resolved using such services. Unauthorised or unknown transactions must also be reported to your bank in addition to using the app's complaint system. NPCI's grievance redressal mechanism clearly states that fraudulent, unknown and unauthorised transaction complaints will be directed to your bank.
Police complaints and investigations
Cyber crime station or any other Police Station having jurisdiction to investigate such offence may investigate the alleged offense.
Cyber forensic report, beneficiary account information and communication details would be relevant to identify the perpetrator.
The Investigation may require records from multiple banks/service providers, which may not be limited to the city of the victim.
Action by police and refund by bank are two different matters. Even if the financial dispute is settled, a cyber crime investigation can proceed, where permissible by law and facts.
What Evidence Is Required for a UPI Fraud Complaint?
Documentation can help prove what transaction took place, who (or what was represented to be) the alleged swindler was and how the victim reacted.
A claim backed up by a paper trail is much easier to investigate than just someone's word.
UPI transaction records
Relevant records may include:
- UPI transaction id / payment reference number
- Date of Payment (dd/mm/yyyy) and Time (approx)
- Amount and Payee UPI ID (if available)
- Bank statement details
- Payment Initiation transaction history
Transaction Reference can differentiate between one wrongful payment from other transactions.
Communications with the suspected fraudster
WhatsApp messages, text messages, emails, ads and call logs can indicate what the purported abuser told the victim. A text message demanding a deposit for a fictitious rental unit, for example, could provide context for why the payment was made. Maintain original electronic evidence if at all possible. Cropped screenshots can lose information that may later become important.
Electronic evidence and authenticity
Electronic records are governed by Bharatiya Sakshya Adhiniyam, 20 23. relating to relevancy and admissibility.
Screenshot may help but again authentication issues of original records and compliance with statutory certification may arise.
Don't change/delete original chats/Messages. Don't forward(copy) private banking documents to many persons.
BK Singh Advocate says Needs well defined timeline of transactions and dependable documentation play crucial role while evaluating complaints of financial scams.
Can Victims Recover Money Lost Through UPI Fraud?
Possibility of recovery depends on the fraud type, where the funds were sent, the bank's responsibility and investigative findings.
Filing a successful criminal complaint will not automatically result in recovery.
Recovery through banking safeguards
If the disputed payment amounts to an unauthorised electronic banking transaction, there could be a possibility of claiming a refund under RBI's customer-protection guidelines. CIIKIDsRBI Facts like whether the bank is at fault, there was an intrusion by a third-party system or customer gave out the credentials for the payment do matter. Bank statement and complainant credit history will be critical evidence.
Recovery of funds held in beneficiary accounts
In some cases banks or law-enforcement agencies may take action that leads to suspected proceeds being frozen or restrained.
Where funds have been frozen, they may be released or unfrozen following additional legal conditions and orders.
Recovery of funds is also dependent on whether there are enough funds available that can be identified and ordered returned.
Civil and other remedies
If funds were transferred as a result of a fraudulent misrepresentation, the facts may give rise to stand-alone civil claims or other remedies as may be available.
Factors such as agreement terms, identity of payee, evidence available and jurisdiction of the forum will bear on the practicality of taking such action.
Civil recovery is separate to criminal culpability.
When a refund is disputed
A bank may claim authorization and the customer may deny ever authorizing the transaction or claim that the bank did not fulfil its responsibilities.
Legally, it makes a difference if the payment was fully unauthorized or if the customer authorized the payment after being tricked.
BK Singh Advocate may help you review contested refund decisions ,bank correspondence and potential additional remedies. No guarantees on retrieval.
Does Reporting UPI Fraud Within Three Working Days Guarantee a Refund?
Not exactly. The Three-Working-Day-Reimbursement Rule of RBI’s customer protection norms doesn’t imply refunds in every instance of fraud. NIL liability:
Where bank is at fault for certain types of unauthorised transactions
If you report certain types of third-party breaches (within the given time)
There can be other exceptions too.
Customer negligence
In instances where a loss occurs due to negligence of the customer, such as when they share their card/payment credentials with another person, there are different liability implications depending on whether it has been reported or not as per the RBI guidelines.
Need to determine if the facts as presented constitute negligence as a matter of law.
Provisional credit and final decisions
The RBI guidelines also prescribe the provisioning and complaints handling requirement for qualifying cases of unauthorised transactions.
Provisional credit does not amount to final adjudication of rights of the customer.
Bank is required to determine liability in accordance with applicable directions and facts of the case.
Whether bank has adequately explained the reason for holding the customer liable in cases where the victim disputes the liability. -BK Singh Advocate
What Happens if the Bank Rejects a UPI Fraud Complaint?
Bank denial is not necessarily the end of the road for your complaint. Here's why: The basis for denial is important. Denials based on customer negligence are different than those dealing with transactions the customer authorized, or disagreement on a reporting date or lack of documentation. Any denial given with a valid reason should be cross-checked with the bank's notes and the governing laws.
Internal grievance escalation
Most banks have a grievance redressal system with escalation features built in. A written complaint and response provides a record of the bank's position. A grievance could be about the purported transaction, the lack of response, failure to consider material evidence or an alleged violation of regulatory requirements.
RBI Ombudsman remedy
Under the Reserve Bank's Integrated Ombudsman Scheme, 2021, there is a complaints mechanism for eligible service deficiencies by a covered regulated entity.
Typically, a customer must first complain to the regulated entity itself. If there is no response within 30 days or the customer is unhappy with the response, an Ombudsman complaint may be available (subject to the terms of the scheme).
An Ombudsman complaint is not a replacement for the investigation of a criminal matter. Rather, it's focus is on the customer's service complaint against the regulated entity.
Choosing the appropriate legal forum
A banking service complaint, criminal complaint and claim against a suspected fraudster are three different things.
They can have different evidence, burdens and remedies.
There can also be forum considerations depending on already started proceedings and rules on concurrent complaints.
BK Singh Advocate can help determine if the victims situation deals mostly with bank responsibility, criminal conduct, a civil contractual dispute or all of the above.
When Should a UPI Fraud Victim Consult a Lawyer?
Legal advice may become necessary if your financial issue escalates into a disputed claim over liability or proof or involving more than one entity.
If your issue is a clear cut technical issue with a payment, your usual app or bank customer service should be able to assist you without going to court.
You may wish to seek other options if your bank has denied you a significant refund or your transaction history is incorrect.
Serious financial loss
May cause loss of funding for important family expenses, repayment of loans or loss of business.
Legal advice can determine what remedies are certain in law and what options are unclear.
Disputed authorisation
Another category contains disputes where there is a disagreement on authorisation by the customer.
For example, the bank may have obtained successful PIN authentication, but the customer claims that the device was controlled by a third party, or that they were misled by a third party into making the payment.
These cases often turn on detailed evaluation of the evidence.
How Can BK Singh Advocate Assist With UPI Fraud Disputes?
Victims often contact attorneys subsequent to receiving various responses from their bank, payment app and police departments.
You may have been informed that the payment went through, the transaction cannot be undone or that they are investigating.
Individually, none of these answers directly address whether a crime occurred or if the bank is at fault.
BK Singh Advocate can provide legal advice regarding the nature of the transaction, your rights, evidence and relevant courts.
Assessment of banking liability
A review may concern transaction authorisation, reporting dates, customer conduct and the relevant RBI protections.

Advice concerning criminal remedies
In cases of alleged impersonation, dishonest inducement or illegal access to an account, the criminal aspects under the law may also have to be examined.
Bharatiya Nyaya Sanhita or IT provisions would apply depending on the facts.
Disputes involving multiple parties
In some situations the defendant can be a merchant, internet intermediary, receiving bank or disputed party.
Attorney consultation can assist in determining who is liable for a specific complaint and if a complaint should be heard at a banking agency, criminal or civil venue.
